Diane Shafer, a loving wife and dedicated mother to three daughters, was killed in November of 2012 when her vehicle was struck by an intoxicated driver. It was a snowy night when 61-year-old Thomas Altobelli struck and killed Shafer. His blood alcohol level was three times the legal limit. Shafer was rushed to the hospital, where she lingered in a coma for two weeks. On December 7, 2012, she died from her injuries.
During the criminal trial, Altobelli was found guilty of operating a vehicle while intoxicated and causing death. He was sentenced to a three to fifteen year sentence.
After the criminal trial, the Shafers filed a wrongful death lawsuit against Altobelli, his insurance company and the bar that served him the night of the fatal crash. Initially, insurance officials with Allstate claimed Altobelli only had $100,000 in insurance coverage. That claim turned out to be false. The lawsuit also named the Green Lantern Bar for negligently serving him alcohol the night of the accident. Witnesses told police that the bar continued serving Altobelli even after he exhibited signs of intoxication. Finally, the parties involved agreed on a $500,000 settlement that will be paid in part from the Allstate insurance and in part from the bar’s liability insurance.
