Tennessee Court Awards Record-Breaking Judgment To Victim Of Hit-And-Run Car Accident.

Accidents resulting in personal injury can occur in a number of ways. From simple slip and fall accidents in a parking lot to injury as a result of a botched medical procedure, there are many scenarios in which negligence can lead to an innocent party sustaining serious injuries. In such a situation, it would be wise to contact an expert personal injury attorney at 617-787-3700.

In 2017, Nashville resident Jennifer Carman was jogging along a roadside when she was suddenly struck by a pickup truck. The driver of the truck, Joshua Kellon, immediately fled from the scene. He was later arrested at his mother’s home. Carman suffered severe injuries, including multiple facial fractures, leg and ankle fractures, and broken bones in both hands. Her thumb needed to be amputated, and she lost her left eye.

A toxicology report found that Kellon was under the influence of several opiates at the time of the crash, although his attorney claimed these were prescription drugs. Kellon was sentenced to four years in prison as a result of a criminal lawsuit brought by the state of Tennessee. However, Carman also brought a civil lawsuit to recover for the injuries she sustained. After a jury trial, Carman was awarded $13.6 million in compensatory personal injury damages and $5 million in punitive damages, a record for the state of Tennessee. The Carman’s attorney, Brandon Bass, who tried the case with attorney Elizabeth Sitgreaves, said he was grateful “that these jurors came back with the courage to come up with a right, just number.”
