Passenger Dies After Being Ejected Out of Car and Run Over Multiple Times.

The convenience, ease and joy that is involved with vehicular travel also carries with it the obligation and duty to behave in a safe, responsible manner. That duty is intended to not only protect the drivers themselves, but also other drivers and the passengers in the vehicles they are driving. When a driver’s actions results in the injury or death of another driver or one of their passengers, the injured party may be able to bring a civil lawsuit against the driver for their personal injury damages.

A lawsuit, unfortunately, may be one of the only ways for a Stoughton, Massachusetts family to recover money damages after a loved one was killed in a car accident. Recently, there was a seven-car accident on Route 24 after Danielson Dacostatavares crashed his 1999 Acura for an unknown reason. Dacostatavares was not seriously injured, but his passenger, twenty-one-year-old Brockton, MA resident Fabricio Tavares, was flung from the car.  Tavares landed in the street, where he was then struck by six other vehicles.  As a result, Tavares suffered extensive traumatic injuries and was pronounced dead at the scene of the auto accident.

Dacostatavares was also injured and was sent to the Good Samaritan Hospital, along with another driver involved in the car accident.  Their injuries were non-life threatening, however, and both men are expected to recover.  Police have not yet found the cause of the motor vehicle accident, but according to wcvb.com, they have charged Dacostatavares with a marked lanes violation, operating under the influence of liquor, and motor vehicle homicide by negligent operation. If Dacostatavares is found to have been drunk or otherwise negligent in the auto accident, he may be held accountable in a civil lawsuit for the injuries that resulted from the accident, including the wrongful death of Tavares.
