On July 3, 2014, a state police trooper was in pursuit of a fleeing motor vehicle in Flint, Michigan.  According to state police officials, the trooper had seen the driver of the vehicle commit a minor traffic violation, and had intended to pull him/her over for a citation.  However, the driver did not pull over, and instead blew through a stop sign.

The trooper, who had been conducting a “ride-along” with a civilian passenger at the time, then sped up to pursue the fleeing vehicle.  As the two cars approached a major intersection, the police cruiser was reportedly traveling at a very high rate of speed.  The trooper also did not have his lights or sirens on.

When the cruiser crossed into the intersection, it collided with a vehicle driven by 61-year-old Precious Cochrane and containing a passenger, as well, 64-year-old Jaqueline Nichols.  The impact of the accident killed Ms. Nichols instantly and Ms. Cochrane suffered major injuries.  The state trooper and his passenger suffered only minor injuries.  The driver of the fleeing vehicle has yet to be identified.

Several days after the horrible accident, a Michigan attorney named Geoffrey Fieger filed a $50 million lawsuit against the state trooper and the State of Michigan.

Tragically, these types of car accidents are far too common.  The truth is that even public servants, who intend to shield the public from harm, can be the source of personal injuries and/or wrongful death caused by negligence.  Police officers, like civilian drivers, are expected to operate their vehicles with a certain level of care and responsibility.  When the operation of these vehicles is no longer responsible or reasonable under the circumstances, they become liable for the damages, such as medical bills, lost wages and pain and suffering, caused to other people or damage to property.
