Buses are essential for transportation in developed, metropolitan areas.  Buses carry us across state lines, transport daily commuters to work, and perhaps, most commonly, are the mode of transportation for the vast majority of students going to and from school.  Buses, however, are not without their risks.  According to statistics published by the National Highway Traffic Safety Administration, 1,392 people died and over 75,000 were injured in Massachusetts bus accidents between the years of 2004 and 2008.  When one of those deaths or injuries is caused because of a bus driver’s negligence, they may be held liable in a personal injury lawsuit for the damages they caused.

The Chicago Transit Authority faced just such a liability after one of their buses struck a University of Chicago student who was traveling on her bike.  According to chicagotribune.com, Ki Shih was bicycling to class on Hyde Park Boulevard when a bus traveling in the same direction hit her, knocked her off her bicycle and continued to drive over her.  Shih suffered multiple injuries, including several fractures in her pelvis and lost the skin off her heel.

After leaving a local hospital, Shih filed a personal injury lawsuit against the Chicago Transit Authority, arguing that their driver was negligent when he struck her bicycle and continued to drive over her.   Shih was seeking compensation for her medical bills, the cost of future professional treatment, her pain and suffering in being run over, and compensation for the future discomfort that she has to endure while she recovers from her injuries.  The lawsuit was scheduled for a trial, but Shih agreed to settle her lawsuit once the defendant offered to pay her $5 million in personal injury damages.
