Two Drivers, A Police Officer, and the City Sued After Connecticut Woman Dies.

Personal injury lawsuits are very complicated matters. Many Massachusetts car accident victims fail to take advantage of benefits that they have available to them through their own Massachusetts auto insurance policies, such as Personal Injury Protection (PIP) coverage for their medical treatment, lost wages and certain other expenses.  An experienced personal injury attorney is aware of these issues and is there to assure you get the highest award possible.  The cases can be particularly complicated if multiple parties are potentially at fault.

The family of Nancy Gibson finds itself in such a situation after she was fatally struck by two vehicles.  According to lawyersandsettlement.com, Nancy left some items on the roof of her car when she was driving home.  When several of the items began falling off, she pulled over and walked onto the road to pick them up.  Unfortunately, a truck came around a corner in the road and struck Nancy.  The truck driver called the police and Officer Michael Peckham came to the scene.  As another driver came down the road, Officer Peckham put on his overhead lights and spotlight to warn the driver of an approaching car that Nancy was in the road.  The second driver, however, alleges that his light blinded her, causing her to run over the already injured 77-year-old.

Nancy tragically died as a result of her injuries. Her estate then brought a wrongful death lawsuit against both drivers, Officer Peckham, and the city of Stonington, Connecticut, Peckham’s employer. The parties managed to reach a settlement for $500,000. The town stated that its insurance company paid $50,000 to settle the claims against the town and Peckham. The first driver, Denis Hale of Stonington, paid $400,000 and the second driver, Beverly Comeau of Ledyard, paid $50,000. Police did not file any criminal charges against either driver.

While no amount of money will bring Nancy back, by successfully bringing a lawsuit against all parties involved, her estate was able to increase the settlement amount.  If you have been injured by a negligent driver, you may be entitled to substantial compensation for your physical injuries, as well as any emotional trauma and financial hardship caused by the accident.  Please contact one of our expert Boston injury lawyers.
